1. ABOUT US?

In this Notice, the terms "JD", "we ", " our ", and " us " are used to refer to JD Sports Fashion plc (only). JD is a controller of your information for the purposes of the Data Protection Laws.

In the following sections we explain how we use your personal information in connection with the Nike Membership at JD Programme, including the sharing of your personal information by JD with Nike Retail B.V. ("Nike"). ("Nike").

2. WHAT IS THE NIKE MEMBERSHIP AT JD PROGRAMME?

In order to become a Nike Member at JD you will need to hold (or create) a JD and a Nike customer account and follow the steps to link those accounts on your local JD website or app. You will be prompted to link your accounts if you decide to sign-up for Member Access offers, products or experiences, or if you try to buy a Member Access exclusive product.

By becoming a Nike Member at JD:

• you will be able to access exclusive member-only products, experiences and offers;
• you will create (if you do not already hold) JD and Nike customer accounts;
• you will link your JD and Nike customer accounts. This means JD and Nike will learn that you have linked your accounts, and by association are a customer of the other company;

Once you have linked your account, JD will share information with Nike about your purchase of Nike and Jordan Brand purchases on JD sites and apps. Nike will use this information to personalise your Nike experiences including by allowing you to view and manage your Nike and Jordan Branded purchases in the Partner Home page within your Nike account; and

• Your Nike Member at JD status and activities may be used by either party to influence their interactions (including marketing) with you.

3. WHAT INFORMATION DO WE COLLECT ABOUT NIKE MEMBERS AT JD AND WHY?

In our (general) privacy notice we explain the information we collect about you when you:

• visit our one of our websites and/or use one of our mobile apps;
• purchase products from us;
• visit one of our stores;
• contact us, for example by telephone, email, post or through submitting a form on our websites and/or our mobile apps.

The only additional information we collect about our customers when they become a Nike Member at JD is:

• that you have successfully linked your JD and Nike accounts and are now a Nike Member at JD – to do this we receive a token from Nike. By association we'll know that you are a Nike customer;
• information about your purchases and redemptions when you purchase and redeem member-only products and benefits – we collect this during your use of our website and app;
• your engagement with Nike Membership at JD pages and communications. Subject to your device/browser permissions, we collect this information automatically from your device and activity.

Customers who do not hold a JD account will be asked to create one during the Nike Membership at JD sign-up process in which you will be prompted to provide your first and last name, an email address, telephone number, password and billing address in order to create your account.

You will also need to create or log in to an account with Nike, you will be prompted to provide this information directly to Nike using a plug-in during the account linking process.

Nike's collection and use of Nike Member at JD information is described in their privacy notice, we also provide some information about how Nike use your information in section 4 immediately below.

4. WHAT PERSONAL INFORMATION DO WE SHARE WITH NIKE?

Information you provide to Nike directly

As part of the account linking process you will be prompted to provide Nike with your Nike account or registration details, and confirmation that you would like Nike to link your JD and Nike accounts.

Information we provide to Nike

Once you have connected your JD and Nike accounts we will share information relating to your future Nike and Jordan branded purchases on JD with Nike. This will include the product purchased (including order IDs), place of purchase, the time and date of your order, the purchase amount, how your order was fulfilled and cancellation/returns information ("Nike Order Information"). Nike use this information to monitor the success of the Nike Membership at JD Programme, to tailor your experiences and interactions with them on the Nike platform (including marketing) and to register your purchases of Nike and Jordan branded products (from JD) within the Partner Home page of your Nike account.

5. LEGAL BASIS FOR PROCESSING PERSONAL INFORMATION

Nike Member at JD personal information is processed to pursue JD's legitimate interests in running the Nike Membership at JD Programme - a loyalty programme run in collaboration with Nike. We will only use your personal information in a way which is reasonable for you to expect as part of the running the Programme, and which does not materially affect your rights and freedoms. Set out below is a description of our legitimate interests when we collect and use information about Nike Members at JD:

6. HOW DOES JD KEEP MY PERSONAL INFORMATION SECURE?

We use appropriate technical and organisational measures to protect the personal information that we collect and process about you. The measures we use are designed to provide a level of security appropriate to the risk of processing your personal information. For the most part we send and receive Nike Member at JD information with Nike using a secure API.

7. MARKETING

The Nike Membership at JD Programme is a customer loyalty programme. This means unless you have taken steps to opt-out of marketing from JD (for example at the account creation stage or within your account settings) then we will send you Nike Member at JD marketing communications on the basis of JD's legitimate interest. Your Nike Member at JD status and activity will also form a part of your profile which is used in connection with JD's wider marketing activities.

You can opt-out of marketing at any time. To do so please click the unsubscribe link within JD marketing communications, by updating your account settings or by contacting Privacy.Support@jdplc.com.

8. UNLINKING YOUR ACCOUNT

You can unlink your JD and Nike accounts at any time. You can do this by signing in to your JD and Nike accounts and by clicking the unlink accounts option within your account settings. You can also unlink your accounts by contacting Privacy.Support@jdplc.com or our customer care team.

By unlinking your accounts you will no longer have access to Member Access products, or be able to enjoy member-only content, experiences and offers. Once you have unlinked your accounts we will no longer send Nike Order Information to Nike and your Nike account.

9. ADDITIONAL PRIVACY INFORMATION

This Notice has been prepared to provide you with specific information relating to the Nike Membership at JD Programme. If you would like to learn more about the processing of your data as a JD customer please visit the (general) JD privacy notice. Our (general) notice also explains:
