New Balance & JD Present: 9060 Launch Party Prize Draw Terms and Conditions

By taking part in this prize draw you accept and agree to these terms and conditions. If you do not agree with any of these terms and conditions then you should not take part in the prize draw. It is your responsibility to ensure that you review the terms and conditions before entering the prize draw. We, JD Sports Fashion plc (“JD Sports”), recommend that you print and store or save a copy of these terms and conditions for future reference during the prize draw. New Balance Athletic Shoes (U.K.) Limited (“New Balance”) is the promoter of this event which is run in conjunction with JD Sports.

This prize draw is not affiliated or endorsed with Instagram, Facebook, Twitter or TikTok.

1. What can you win?

There will be a maximum of two hundred and fifty (250) winners who will each win:

• One (1) standard entry ticket to attend the New Balance & JD Present: 9060 Launch Party with Cat Burns (Address - Versa Studio 12, Goods Yard Street, Manchester M3 3BG) to take place on Wednesday 9 February 2024 between 19:00pm - 22:30pm (UK Time). Winners will be entitled to free drinks inside the venue (the “Prize“).

The Prize is subject to availability and awarded on a first come first serve basis. JD Sports has the right to change, alter or withdraw the prize draw or Prize at any time due to any change in any applicable law or any events outside the control of JD Sports. JD Sports shall not be responsible for any delay, cancellation or rescheduling of the Prize. If any part of the Prize is not claimed (for whatever reason), JD Sports is under no obligation to supply an alternative prize.

The Prize is personal to the winner. The Prize is not available for sale, transfer, resale, donation, or exchange. Exchanging any part of the Prize package is strictly prohibited (including, without limitation, in person or online via an online auction website or online resale marketplace). JD Sports reserves the right to cancel the prize draw and withdraw or make void the Prize if these terms and conditions are not complied with. JD Sports and/or New Balance shall not be responsible for any delay, cancellation or rescheduling of the Prize. If any part of the Prize is not available (for whatever reason) or claimed, JD Sports and/or New Balance is under no obligation to supply an alternative Prize.

2. What is excluded from the Prize?

It is the winners’ responsibility to organise and pay for anything excluded from the Prize. Travel to and from the Prize event and any food or drink purchased/consumed is excluded.

3. Who can enter?

Entrants must be:

• aged 18 years or over; • a resident of England, Scotland or Wales; and • be available to attend the Prize event on Wednesday 9 February 2024 between 19:00pm - 22:30pm.

JD Sports reserves the right to ask the winner’s to provide proof of age. Employees (and their immediate family) of the JD Sports group http://www.jdplc.com/our-group/sports-fashion.aspx. or anyone else professionally connected with this prize draw are not eligible to enter the prize draw. JD Sports reserves the right (at its sole discretion) to decide if the eligibility criteria are met. If the eligibility criteria are not met, the entry will be invalid.

4. How to enter

Entrants can enter the prize draw by following each of the steps below: 1. Clicking on the link in the collaboration Instagram post with New Balance and JD Sports (the “Post”); 2. Clicking the link on the Post to redirect you to the Skiddle website; and 3. completing and submitting the entry sheet to secure a free ticket.

Internet service providers’ fees may apply when accessing the internet. No purchase is necessary to enter the prize draw.

Participation is limited to one entry per person only. If more than one such entry is received, only the first entry will be accepted. No responsibility is taken for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason.

Entry to the Prize event is subject to any entry or attendance requirements set by New Balance, its agents and/or the venue.

5. Closing Times

The prize draw will commence on 5 February 2024 at 18:00pm (UK time) and will end on 9 February 2023 at 19:00pm (UK time), or while tickets last (whichever occurs earlier). Any entries received after this date and time will not be valid.

6. How are winners selected?

The first two hundred and fifty (250) entrants who have made a valid entry following the “How to Enter” steps above will instantly receive confirmation that they have won a ticket to the Prize event.

No correspondence will be entered into regarding denied access. All entrants will be automatically confirmed upon completing their form. The decision of New Balance and JD Sports is final and binding on all entrants. No correspondence will be entered into regarding the selection of the winners (other than with the winners themselves).

7. Winner’s Responsibilities

It is the winners’ responsibility to:

It is the winners’ responsibility to: (i) organise and pay costs for anything excluded from the Prize, including travel to and from the Prize event and refreshments; (ii) complete all stages of the How to enter section above and present evidence of such completion to security team at the Prize Event; (iii) provide accurate contact details; (iv) provide valid proof of age, which is required to enter the Prize event; (v) adhere to local laws in the UK; and (v) comply with any rules, instructions, requirements, terms and conditions or regulations of the event organiser (including, but not limited to New Balance).

JD Sports and/or New Balance will not be liable to the winners or any other persons where they fail to comply with such responsibilities and any such failure may result in forfeiture of the Prize.

8. Personal information

By ticking the appropriate opt-in boxes you agree that you will receive regular communication from JD Sports (and its affiliates). JD Sports will use personal information which you provide, or which we obtain through our dealings with you, to sign you up to marketing materials provided by JD Sports (and its affiliates) and to administer the prize draw. We may also use your personal data to tell you about JD Sports (and its affiliates) products and offers, and for market research including analysis and development of our products and customer relationships. 9. Publicity

By taking part in the prize draw, entrants may be invited to participate in publicity at JD Sports’ request if they are a winner of the prize draw. Entrants agree that JD Sports (or any third party nominated by JD Sports included but not limited to New Balance) may in its sole discretion use their comments relating to the Prize and their experience for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid (including for the avoidance of doubt when responding to any third party).

JD Sports reserves the right to withdraw the Prize (or any part of it) if a winners breaches any of the terms in these terms and conditions or if they are found to have acted in a dishonest or fraudulent manner.

10. Liability

The Prize event is being ran by New Balance. JD Sports shall have no liability whatsoever in relation to the Prize other than as set out in these terms and conditions.

Nothing in these terms and conditions limits any liability which cannot legally be limited, including liability for:

a. death or personal injury caused by negligence; b. fraud or fraudulent misrepresentation; or c. any liability that cannot be limited or excluded by law.

Subject to any liability which cannot be limited (as set out above) all event attendees hereby acknowledge that JD Sports has no association with the venue and acknowledge and confirm that they have no claim or right of action of any kind, arising in any capacity or in any jurisdiction, against JD Sports or any of its officers or employees in respect of their admission, attendance, participation or experience at the event.

11. Which law applies to this prize draw?

This prize draw is governed by the law of England and Wales and the participants of the prize draw submit to the exclusive jurisdiction of the courts in England and Wales.
